WHAT HAPPENS WHEN MY PAROLE EXPIRES? 

If you are an Afghan citizen who arrived as part of Operation Allies Refuge in late 2021, you likely received a 2-year parole when you entered the United States. Parole is permission to live and work in the United States.  Understandably, you may be concerned about what will happen when your parole expires. This guide is intended to help answer your questions and give you an opportunity to get more advice as needed.

Parole Expiration FAQ

Will I be deported back to Afghanistan when my parole expires?

​

  • There will not be any automatic deportations when parole expires.  When your parole expires, if you have not received another form of immigration status, you will be considered undocumented.  Undocumented means that you do not have current status in the U.S. 

​

  • Even when undocumented you cannot be automatically deported. To be deported, you must be placed in immigration removal proceedings. In proceedings, you have an opportunity to apply for permission to stay in the United States before an Immigration Judge. 

​

  • Individuals with pending asylum, temporary protected status, and green card applications are authorized to remain in the United States until they receive their decision.  

​

  • You should always seek legal advice if you have interactions with the police or if you plan to travel outside of the U.S. 

​

If I am receiving public benefits (Medicaid or SNAP, for instance), will I continue to receive those benefits after my parole expires?

​

  • Your eligibility for public benefits in Missouri may be affected unless you are granted re-parole before your parole expires.     

​

​

  • You may want to plan now as if your benefits are going to expire.  For instance, if your family currently has Medicaid benefits, you might plan to get vaccinations and have any necessary doctor’s appointments before your parole expires. 

​

  • Unfortunately, Asylum Clinic KC cannot advise you on your eligibility for or assist in applying for benefits.   

​

If my parole expires, will it affect my existing case or my ability to file for any other immigration benefits?

​

  • The expiration of your parole will not affect your pending application for COM approval, asylum application, green card application or temporary protected status application. 

​

  • If you do not have a pending asylum application and believe that you may want to apply for asylum, you must file your asylum application either before your parole expires or within a reasonable time (generally 6 months or less) after your parole expires.  

​

  • If you are not granted re-parole before your parole expires, you may need to file an asylum application within 6 months to maintain your eligibility for asylum. 

​

If my parole expires, will I be allowed to continue to work? 

​

  • Your Employment Authorization Document (EAD) has an expiration date printed on it that may differ from the date that your parole expires.  You may continue working as long as your EAD has not yet expired.  If your EAD expires, then you will need a new EAD.  Please see additional information below on how to obtain a new EAD. 

​

Am I entitled to a new Employment Authorization Document (EAD) if I have a pending asylum application (Form I-589)?

​

  • If you have filed an asylum application and it has been pending for at least 150 days, you and the members of your family included in your asylum application are eligible to apply for new Employment Authorization Documents (EAD).   If you think you are eligible for a new EAD and have not yet applied for it, you may contact Asylum Clinic KC by WhatsApp at 816-536-8231 or call our office at 816-722-3444 to request assistance.  Your message will be returned during regular office hours Monday through Friday 9am-5pm. 

 

  • In addition, the USCIS has announced it will automatically consider you for re-parole because you have an asylum application pending.  If the USCIS grants you re-parole, your existing employment authorization will be extended.  The USCIS will send you a Form I-797C, Notice of Additional Action that you can use as proof of authorization to work.

Am I entitled to a new Employment Authorization Document (EAD) if I have a pending Chief of Mission Application (Form DS-157)?

​

  • If you do not have an asylum application or green card application pending, you should apply for re-parole as soon as possible.  If the USCIS grants you re-parole, you will automatically be granted work authorization.  The USCIS will send you a Form I-797C, Notice of Additional Action that you can use as proof of authorization to work.  

​

Am I entitled to a new Employment Authorization Document (EAD) if I have a pending green card application (Form I-485)?

​

  • You are allowed to apply for a new Employment Authorization Document (EAD) when you apply for your green card.  If you did not apply for a new EAD with your green card application, you can do so now.   

​

  • In addition, the USCIS has announced it will automatically consider you for re-parole because you have a green card application pending.  If the USCIS grants you re-parole, you will automatically be granted work authorization.  The USCIS will send you a Form I-797C, Notice of Additional Action that you can use as proof of authorization to work.  

​

Am I entitled to a new Employment Authorization Document (EAD) if I have a pending Application for Temporary Protected Status?   

​

  • You are allowed to apply for a new Employment Authorization Document (EAD) when you apply for temporary protected status.  If you did not apply for a new EAD with your TPS application, you can do so now.   

​

  • In addition, if you do not have an asylum application or green card application pending, you should apply for re-parole as soon as possible.  If the USCIS grants you re-parole, your existing employment authorization will be extended.  The USCIS will send you a Form I-797C, Notice of Additional Action that you can use as proof of authorization to work.  

Re-Parole Information

What is Re-Parole?  Am I eligible for it? 

​

  • The U.S. Citizenship and Immigration Services (USCIS) announced in June 2023 that it would offer “re-parole” which is a new fee-exempt process that allows eligible Afghan nationals, to continue living and working in the United States as parolees for an additional two years.   

​

  • You are eligible to apply for re-parole if your I-94 shows your class of admission as either “OAR” or “PAR.” 

​

How do I apply for re-parole? 

​

  • The USCIS announced that it would consider all OAR parolees with pending asylum applications and green card applications for re-parole.  So, if you have an asylum application or green card application pending then there is nothing further you need to do to apply for re-parole for yourself and (if you have a pending asylum application) the family members included in your asylum application.  It is not yet clear how long the USCIS will take to issue re-parole to people with pending asylum and green card applications.  

​

  • If you do not have a pending asylum application or green card application, you must request re-parole by completing a Form I-131.  It is not yet clear how long the USCIS will take to issue re-parole once you have applied.  

​
